Please take a moment to read these terms before engaging Baan Legal for any service. They set out the basis on which we work together, the responsibilities of each party, and a few practical matters that help things run smoothly. If anything is unclear, we are always glad to talk it through before you proceed.
1. Definitions
In these terms and conditions, the following expressions have the meanings given to them here:
- "Baan Legal", "we", "us", "our" — refers to Baan Legal, a family legal services practice operating at 215 Yaowarat Road, Samphanthawong, Bangkok 10100, Thailand.
- "Client", "you", "your" — refers to any individual or family who engages or enquires about our services.
- "Services" — refers to the legal services we provide, including Separation Advice, Parenting Plan Support, and Agreement Drafting & Review, as described on our website.
- "Agreement" — the engagement formed when you instruct us to proceed with a service, governed by these terms.
- "Website" — our website at baanklegal.world.
2. Acceptance of Terms
By contacting us to enquire about or engage our services, you confirm that:
- You are 18 years of age or older, or are a legal guardian acting on behalf of a minor.
- You have the legal capacity to enter into this agreement.
- You have read and understood these terms and accept them as the basis for our engagement.
If you do not agree with any part of these terms, please do not proceed with our services. We are happy to discuss any questions before you commit.
3. Services
Baan Legal provides family legal services to clients located primarily in Thailand. Our current service offerings are:
- Separation Advice (฿1,430) — An initial consultation and written overview to help individuals or couples understand their options when considering separation.
- Parenting Plan Support (฿2,960) — Preparation and supportive guidance to help parents shape a parenting arrangement that prioritises children's wellbeing.
- Agreement Drafting & Review (฿4,110) — Careful drafting or review of family agreements, explained plainly and prepared at a pace comfortable for all parties.
Service availability may vary. We will advise you promptly if we are unable to assist with a particular matter. All services are provided in English unless otherwise agreed in writing.
4. Client Responsibilities
To allow us to assist you properly, we ask that you:
- Provide accurate, complete, and truthful information about your situation.
- Notify us promptly of any changes to the information you have shared.
- Engage with us respectfully and in good faith throughout our work together.
- Not use our services in connection with any activity that is unlawful or contrary to the interests of a child's wellbeing.
- Respond to our communications within a reasonable timeframe to help keep matters progressing.
We reserve the right to decline or discontinue a matter if information provided is found to be materially inaccurate or if conduct during the engagement makes it impractical to continue.
5. Intellectual Property
All content on our website — including text, structure, and design — belongs to Baan Legal and may not be reproduced without written permission.
Documents, written overviews, and parenting plan drafts produced specifically for you in the course of your engagement are prepared for your personal use. You may not share, publish, or use them commercially without prior written consent.
General methodologies, templates, and working practices developed by Baan Legal remain our property regardless of their use in your matter.
6. Fees & Payment
Our service fees are stated in Thai Baht (฿) and are as shown on our website at the time of engagement. Fees are subject to change; any change will be communicated before it applies to your matter.
- Payment arrangements will be discussed and agreed before work commences.
- We will issue a clear summary of charges before or at the start of the service.
- If your circumstances change partway through an engagement, we will discuss any adjustment to fees with you openly before proceeding.
- All fees are exclusive of any applicable taxes unless stated otherwise.
Refunds are considered on a case-by-case basis where services have not been substantially delivered. Please contact us to discuss any concerns about charges.
7. Confidentiality
We treat everything you share with us as confidential. Personal details, family circumstances, and documents provided during your engagement will not be disclosed to third parties except:
- Where you have given explicit consent.
- Where disclosure is required by Thai law or by a court order.
- Where disclosure is necessary to prevent serious harm to a child or vulnerable person.
We ask that you treat any guidance, documents, or working materials shared by us with the same discretion.
8. Disclaimers
Our services are provided with care and professional attention. However, please be aware that:
- Legal outcomes in family matters depend on many factors outside our control, including the decisions of courts and other parties.
- Information on our website is general in nature and does not constitute legal advice for your specific situation.
- We make no representation about the outcome of any separation, parenting arrangement, or agreement.
- Our services are provided in good faith and based on the information you supply; we cannot be responsible for outcomes affected by incomplete or inaccurate information.
9. Limitation of Liability
To the extent permitted by Thai law, Baan Legal's liability in connection with any engagement is limited to the fees paid by you for that specific service.
We are not liable for indirect, consequential, or incidental losses arising from our advice or services, including decisions made by courts, other parties, or regulatory bodies.
Nothing in these terms limits liability for fraud, willful misconduct, or any liability that cannot be excluded under applicable law.
10. Termination
Either party may bring an engagement to a close at any time by giving reasonable written notice. If you decide not to continue, please let us know as early as possible so we can close your matter cleanly.
We may bring an engagement to a close if:
- Continuing would create a conflict of interest.
- We are unable to obtain the information needed to assist properly.
- There has been a material breakdown of the working relationship.
- Continuing would conflict with our professional or legal obligations.
Provisions relating to confidentiality, intellectual property, and payment for work already completed survive termination of any engagement.
11. Dispute Resolution
If you have a concern about our service, we always ask that you raise it with us directly first. Most matters can be resolved through an open conversation, and we are committed to addressing any feedback promptly and in good faith.
These terms are governed by the laws of the Kingdom of Thailand. Any dispute that cannot be resolved informally between us shall be subject to the jurisdiction of the Thai courts.
Where both parties agree, disputes may be referred to mediation before any court proceedings are commenced.
12. General Provisions
- Entire agreement. These terms, together with any written engagement summary we provide, form the complete agreement between us for the services described.
- Severability. If any part of these terms is found to be unenforceable, the remaining parts continue to apply.
- Waiver. A failure by either party to enforce a provision at any time does not waive the right to enforce it in the future.
- Assignment. You may not transfer your rights under these terms to another person. We may transfer our obligations to a suitably qualified successor, with notice to you.
- Notices. Any formal notice should be sent in writing to our address below or to [email protected].
13. Changes to These Terms
We may update these terms from time to time. When we do, the updated version will be posted on our website with a revised date at the top. Changes do not affect engagements already underway unless both parties agree in writing.
We encourage you to review this page if you are considering engaging us again after some time has passed.
